General terms and conditions

Artikel 1: General information

1. By placing an order with Mevrouw Vermeer B.V. you as the other party are accepting the terms and conditions of delivery and the payment of Mevrouw Vermeer B.V. Mevrouw Vermeer B.V. has the right to amend its delivery and/or payment terms and conditions after expiration of the term.
2. Both the Mevrouw Vermeer B.V. website www.mevrouwvermeer.nl and the Belly Bandit web site www.bellybandit.eu  are part of Mevrouw Vermeer B.V.
3. The definition ‘other party’ refers to every visitor of the website, or any natural person or legal entity that purchases a product and/or service via the website or in any other remote way.
4. ‘Remote purchase’ is referred to an organised system for sales and service provision on distance, where only technologies for remote communication are used to enter into an agreement.
5. Mevrouw Vermeer B.V reserves the right to occasionally modify or complete these general terms and conditions.
6. By the use of the websites of Mevrouw Vermeer B.V. and/or placing an order, the other party accepts the general terms and conditions as well as all other rights and obligations that are displayed on the website.

Artikel 2: Prices

1. All prices are stated in Euros and include 19% VAT.
2. All offerings of Mevrouw Vermeer B.V. are free of obligation, unless an acceptance period is defined. An offering will expire in case there is no more availability of the products concerning the offering in between times.
3. The other party is liable to pay Mevrouw Vermeer B.V. the amount stated in the order confirmation. Apparent (manipulated) errors in the price quotation such as evident inaccuracies can also be corrected by Mevrouw Vermeer B.V. after realization of the agreement.

Artikel 3: Payment

1. Mevrouw Vermeer B.V. attaches great importance to enable the other party to pay safely and securely, especially if the other party pays via internet. For this purpose Mevrouw Vermeer B.V. has taken steps to allow the other party to pay safely. Mevrouw Vermeer B.V. does not bear nor accept any reliability or liability in regards to this.
2. During the realization of the agreement the other party determines the method for payment. The other party can pay in the following ways: iDeal, PayPal or by bank transfer.
3. In case credit card is elected as the payment method, the terms and conditions of the credit card company apply. Mevrouw Vermeer B.V. will not be party between the other party and the credit card company.
4. Mevrouw Vermeer B.V. will deliver the product once the payment has been received.
5. The agreement for purchase and sale will be realised by acceptance of the offer and fulfilling the corresponding conditions. An agreement is realized once the order has been placed.
6. In case that after the realization of the agreement it is found that the payment has been cancelled by the other party or any third party, this will result in a direct claim of Mevrouw Vermeer B.V. to the other party.

Artikel 4: Shipping

1. Within Netherlands, shipping of all our products to private individuals will be free of charge.
2. For distributive trade the shipping costs, both within and outside Europe, will be charged. Information of shipping charges will be provided on request, please contact info@mevrouwvermeer.nl or info@bellybandit.eu.
3. In case of returns, return shipping charges will not be reimbursed.
4. Mevrouw Vermeer B.V. will give great attention in carefully receiving and realizing the order of the products and assessing requests for the provision of services. Orders will be delivered as soon as possible.
5. Once the financial transaction has taken place, Mevrouw Vermeer B.V. aims to deliver the order by TNT mail within 5 days.
6. If a time limit for the completion of certain services or the delivery of certain resources has been agreed or stated, then this will never be a fatal deadline. In case of infringement, the other party needs to hold Mevrouw Vermeer B.V. liable in writing. Mevrouw Vermeer B.V. should then be offered a reasonable time to still execute that what has been agreed upon.
7. Infringement of any delivery term does not grant the other party the right for compensation, the right to cancel the order or to dissolve the agreement.
8. As soon as the products to be delivered have been delivered at the other party’s destination, the risk with respect to these products will transfer to the other party. In case of offering to no avail at the address indicated by the other party and/or the post office, respectively to the neighbours of the other party, the risk will transfer at the moment of offering in vain and/or delivery at the post office or the neighbours of the other party.
9. Within seconds after completing the purchase order, the other party will receive a written confirmation by email of the realized agreement. If the other party did not receive any confirmation, then Mevrouw Vermeer B.V. should be contacted via info@mevrouwvermeer.nl or  info@bellybandit.eu. 

Artikel 5: Information

1. The other party is responsible for providing accurate, complete and up-to-date information to Mevrouw Vermeer B.V.  Besides, the other party guarantees to be legally authorized to employ the web store of Mevrouw Vermeer or Belly Bandit.
2. Mevrouw Vermeer B.V. guarantees that personal data will be processed with the greatest care.
3. Mevrouw Vermeer B.V. preserves the right to use the email address of the other party for mailings of solely Mevrouw Vermeer B.V. or Belly Bandit.

Artikel 6: Sight period/right to recall

1. ‘Sight term’ is understood to be the term in which the other party can exercise its rights to recall.
2. In case of purchase, the other party is entitled to a sight period of seven working days in which the agreement can be dissolved and the ordered goods can be returned to the sender without stating grounds.
3. The ‘sight term’ comes into effect on the day of receipt by the other party.
4. The right to recall is only valid in the case that the product is sent back stamped, unused and in its original state to Mevrouw Vermeer B.V., J.F. Vlekkeweg 10-08, 5026 RJ Tilburg, the Netherlands.
5. Mevrouw Vermeer B.V. will return the amount paid within 30 days after receipt, providing that the concerned product is unused and undamaged.
6. The order confirmation should be enclosed by the other party when sending back the product.

Artikel 7: Restriction of ownership

1. Ownership of the products will, notwithstanding its actual delivery, transfer to the other party once all which is due, concerning the agreement with Mevrouw Vermeer B.V. has been fulfilled by the owner, likewise including the reimbursement of costs.
2. The other party may not encumber, sell, resell, alienate or burden the products otherwise before its ownership has been transferred.

Artikel 8: Guarantee and liability

1. Mevrouw Vermeer B.V. guarantees that the delivered goods meet the specifications stated on the website, the common reasonable requirements of quality and/or utility, not conflicting with existing government regulations. The general guarantee of terms and conditions apply. This guarantee is established by the manufacturer or the importer. The rights of the other party concerning the guarantee of this product arise from impeding dictated legal regulations, unimpeded.
2. Guarantee is out of the question in case of customary wear and tear of the product.
3. Mevrouw Vermeer B.V. is never restricted to payment of any indemnification, unless there is a question of intention or flagrant blame from the part of Mevrouw Vermeer B.V. Mevrouw Vermeer B.V. is never liable for consequential or company loss, indirect loss and the loss of sales and profit.
4. If Mevrouw Vermeer B.V., for whatever reason, is liable for damage claims, then this amount will never be higher than the value of the invoice concerned for the product or service causing the loss.
5. The information on the website has been composed with the greatest care. However, Mevrouw Vermeer B.V. cannot guarantee the accuracy of the contents of the information. Mevrouw Vermeer B.V. is not liable for any error, inaccuracies, misapprehensions, delays or the incorrect transmission of the order and notifications due to the use of the internet or any other means of communication between the other party and Mevrouw Vermeer B.V.
6. Mevrouw Vermeer B.V. is not liable for any loss either caused by the temporary unavailability of the order facility, unavailability or removal of the website due to maintenance or likewise.
7. Mevrouw Vermeer B.V. cannot be held liable for the incorrect use of the Belly Bandit. The Belly Bandit should be used after and not during pregnancy.

Artikel 9: Miscellaneous

1. The general terms and conditions can be found at www.mevrouwvermeer.nl  and www.bellybandit.eu.
2. When and in case any of the general terms and conditions are nullified or made invalid, the other terms of the general terms and conditions will remain valid without prejudice. Mevrouw Vermeer B.V. will establish a new substitute condition, where the original condition will be regarded as much as possible.
3. Dutch (the Netherlands) law applies to Mevrouw Vermeer B.V.
